Terms of Service | Command Stone

These Terms of Service ("Terms") are a legally binding agreement between you and Command Stone Private Partners Inc. ("Company," "we," "us," or "our") concerning your access to and use of commandstone.com, Stonebook, and any related media, applications, or services (collectively, the "Site").

Eligibility

By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Site. The Site is intended for persons who are at least 18 years old. By using the Site, you represent that you have the legal capacity to enter into these Terms.

Description of the Site

Command Stone sells Stonebook, a read-only book of record for registered investment advisers and family offices. Stonebook consolidates custodian files with client-supplied, dated private marks and produces reports. Command Stone measures and reports. It does not provide investment advice, take custody of assets, place trades, rate, score, or recommend securities.

Firm-level licences are sold as annual subscriptions with unlimited seats. You are responsible for maintaining the confidentiality of login credentials issued to your firm and for all activity under those credentials. You will not share access outside your firm except as we expressly permit in writing. You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the Site; (c) interfere with the security or operation of the Site; (d) upload malicious code; (e) scrape the Site except through documented interfaces we provide; or (f) misrepresent the origin of data you enter, including private marks.

Intellectual property

The Site, Stonebook, and all related trademarks, logos, text, graphics, and software are owned by Command Stone Private Partners Inc. or its licensors. You receive a limited, non-exclusive, non-transferable licence to use Stonebook during a paid term. You retain ownership of data you supply. We do not claim ownership of your custodian files or private marks.

We may suspend or terminate access if you breach these Terms. You may stop using the Site at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.

SMS and text messaging

By providing your mobile number and opting in, you agree to receive promotional marketing text messages from Command Stone. Message frequency varies. Message and data rates may apply. Disclaimers

THE SITE AND STONEBOOK ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Stonebook flags apparent discrepancies. It does not audit, certify, or warrant the accuracy of custodian files or private marks you enter. Reports are not investment advice.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMAND STONE PRIVATE PARTNERS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. You will indemnify and hold harmless Command Stone Private Partners Inc. and its officers, directors, employees, and agents from claims arising out of your use of the Site, your data, or your breach of these Terms.

Governing law and contact
